Filing a VA disability claim for an asbestos-related condition is done directly with the U.S. Department of Veterans Affairs — not through a law firm — and veterans can get free, expert help doing it. Here is how the process works and where to turn.

What You Need

  • Your DD-214 (discharge papers) showing Navy service during the relevant era
  • A diagnosis of mesothelioma, asbestosis, or asbestos-related lung cancer from a licensed physician
  • Any records that help (service records, medical records)

Under the presumptive service connection in 38 CFR § 3.309(d), you generally do not have to prove the specific ship, compartment, or product that exposed you.

  • By phone. Call the VA at 1-800-827-1000.
  • Veterans Service Organizations (recommended). DAV, VFW, and the American Legion have VA-accredited representatives who help veterans file claims for free. A VSO service officer can prepare and submit the claim, gather evidence, and represent the veteran through the process at no charge.

Using a VSO is often the easiest path — their representatives do this every day and cost nothing.

What to Expect

  • The VA reviews the claim and assigns a disability rating (mesothelioma is generally rated 100%).
  • Decisions commonly take 6–18 months, though serious illnesses like mesothelioma may be expedited.
  • There is no statute of limitations — a claim can be filed at any time after diagnosis.
  • Survivors may separately qualify for DIC benefits.

Don’t Overlook the Separate Civil Claim
